1. Acceptance of Terms
By engaging with my (PageSpeedWizard) website speed optimization services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use my services.
2. Services
I will provide speed optimization services for your website, aiming to improve loading times and user experience. The cost of any third-party tools, plugins, or extensions required for the optimization is not included, and it is your responsibility to acquire and pay for these tools. Any work, optimizations, or improvements provided as part of my service remain my exclusive property until full payment has been received. You do not have the right to use or implement these optimizations until full payment is made.
3. Payment
Payment details and terms will be outlined in a separate agreement or invoice. Payment is expected in two stages: a 50% deposit of the total amount is due before project initiation, and the remaining balance must be settled before the project’s delivery.
4. Confidentiality
I respect your website’s privacy and will not share or disclose any confidential information.
5. Copyright and Ownership
Any work, optimizations, or improvements provided as part of my service, after full payment has been made, remain your property. However, I reserve the right to showcase the work as part of my portfolio, with your approval.
6. Cancellation and Refunds
You may request the cancellation of my website speed optimization services at any time. To initiate a cancellation, please provide me with a formal notice. Upon receiving the notice, I will review the request, and the cancellation will be processed as per the terms outlined below:
a) Satisfaction Guarantee: If you are not satisfied with the services provided, you can make a refund request within 14 days, starting from the date of service completion.
b) Ownership of Work: Any work, optimizations, or improvements undertaken by me as part of the service remain my property until payment is received in full.
c) Refund Process: Upon approval of a refund request, you will receive a reimbursement equal to the amount paid for the services. You will not have the right to use or implement the optimizations or improvements provided.
Exemptions:
- The “Satisfaction Guarantee” policy does not apply to services rendered where you have already implemented the optimizations to your live website.
- Any service fees related to third-party tools or products are non-refundable.
- I reserve the right to refuse refunds if I deem that you are abusing the “Satisfaction or Reimbursement” policy.
7. Limitations of Liability
I will not be responsible for any indirect, consequential, or incidental damages. My liability is limited to the total amount paid for the services.
8. Changes to Terms
I reserve the right to modify these terms at any time. You will be notified of any changes.
9. Termination
I reserve the right to terminate services at any time if you breach these terms or engage in activities that may harm my business.
10. Platform Compatibility
While I strive to provide optimization services for various website platforms, some techniques or tools may not be applicable or allowed on certain platforms. I will inform you of any limitations or platform-specific considerations before beginning the optimization process.
11. Client Responsibilities
You are responsible for providing necessary access to your website, hosting account, and any required platform-specific accounts for the duration of the optimization process. You are also responsible for maintaining regular backups of your website before and during the optimization process.
12. Third-Party Services and Integrations
My optimization services may require the use of third-party services or integrations. While I will make recommendations based on best practices, you are responsible for any associated costs and for ensuring compliance with the terms and conditions of these third-party services.
13. Performance Guarantees
While I strive to significantly improve website speed and performance, specific results cannot be guaranteed due to various factors such as hosting environment, website complexity, and external dependencies. I commit to applying industry best practices and proven optimization techniques to achieve the best possible results for each unique situation.
14. Ongoing Maintenance
Unless explicitly stated in a separate agreement, my services do not include ongoing maintenance or support after the initial optimization process is complete. I recommend that you maintain your optimized website state by following best practices for content and asset management.
